Just a few examples of actual Identity Restoration Case Files
Identity Restoration Case #1 involves a client that had multi-state and multiple fraudulent checks forged and transacted through various Wal-Mart centers from South Carolina, through Tennessee, Georgia, and Florida. In sum, the member was victimized by over $14,000.00, affecting even their business accounts. The client’s bank refused to work to resolve the issue or to provide requested documentation). The bank became unresponsive to the member’s repeated requests for assistance, refusing to refund any money to the client. The FRS stepped in to assist the client by initiating disputes about unauthorized withdrawals with the bank and Wal-Mart. The FRS contacted various state and federal law enforcement agencies. After receiving the formal dispute letter demonstrating that Wal-Mart faced potentially large civil and administrative liabilities and penalties, all the amounts converted from the forgeries were refunded to the client. What stands out in this case is not only that the entire $14,000.00+ funds were recovered, but also that the client did not realize the funds were missing within the first 60-days, which is the period when the bank would normally refund such losses to the customer. The positions Wal-Mart and the bank held were neutralized by the points contended within the dispute letter prepared by the FRS. This was a complex and emotional situation for the client. The costs in savings for the client had an attorney done the recovery would have been from $5000-8000.00 based on a rate of $300.00 per hour. The case resolved in about 5 months with a full recovery.

Identity Restoration Case #2 involves a client who was receiving notices from the IRS indicating he had income reported that he had not paid taxes on. An investigation with IRS was opened. The event prompted the client to pull a credit report. The client was made aware during the process that he had an open collection account reporting on his credit report that was not his. The collection agency advised the client that the collection was related to a criminal restitution charge using his personal information. The client was told he needed to contact judge involved in the case to get it resolved. The Restoration Service started working on case with the District Attorneys Office of Mesa County and Colorado Bureau of Investigation to open an investigation into the alleged charges. The investigation began in September 2010. The Restoration Service assisted in obtaining all needed items from client in order to clear his name. A full investigation including fingerprint analysis had to be done in order to clear the client. The Restoration Service continues to work with the client and the Mesa County DA in an attempt to get the records sealed. During the investigation, the Restoration Service determined there is in fact another criminal record showing up under client’s name. The Restoration Service is working with authorities to address this case as well. The identity theft has made it difficult for client to obtain needed licensing for his profession. The Restoration Service has provided documentation to the licensing department to make sure he can now obtain the needed licensing. Estimated time spent on this case to date is approximately 75 hours, thereby saving the client $25,000 to $30,000 in attorney fees up to this point.

Identity Restoration Case #3 involved a judgment on a member’s credit report in the sum of $60,250 from the New York Workers Compensation Board. The member was a business owner and was adamant that he did not owe this money personally, nor did his company. Our office contacted the Workers Compensation Board (WCB) to find out more information and they were not able to locate the judgment in their records using the member’s Social Security Number. The WCB referred our office to Advocate for Business. The Restoration Service contacted them and was immediately put in touch with a very helpful representative. The Restoration Service also contacted the member to get his Federal Employee ID Number. Using the FEIN, the gentleman at Advocate for Business was able to locate the judgment and contact other departments at the WCB who were able to determine it did not belong to the member. Apparently there were several hundred businesses with the same name and that is probably how the mix up occurred. A week or so later, The Restoration Service received a Stipulation in the mail vacating the judgment immediately of $60,250 and signed by the attorney for the WCB. The Restoration Service forwarded the Stipulation to the courthouse for filing, and then after receiving a file-stamped copy back, forwarded the Stipulation to the credit reporting agencies. The judgment was successfully removed from the member’s credit report.

Identity Restoration Case #4 involved a member’s Social Security Number being used by a criminal in another state. The member was a well-traveled, international businessman. He became aware of the fraud when he was stopped by security on one of his international flights. His name had been placed on a criminal watch list. He had not been denied entry to a flight but was concerned that would happen in the future. Because of the member’s high position in his company, he had a staff of people available to work on the situation for him. The member and his associates contacted our company for advice on how to proceed. Our company recommended they contact the police department in the jurisdiction where the fraudster was arrested and work on obtaining a “Certificate of Id Theft” or “Certificate of Innocence,” which the member could carry with him while traveling. We also recommended contacting the FBI or Federal Department of Justice to assist clearing the member’s name from the National Criminal Databases. The member’s name was successfully cleared from the criminal watch list.
